I.                   Policy

 

It is the policy of Tarry House, Inc. to hire employees and admit persons served without regard to race, color, national origin, religion, gender, sexual orientation, disability, or age. The same requirements are applied to all applicants for employment, educational experiences and recovery services. The Executive Director is the person designated to coordinate agency compliance with all laws pertaining to the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, as amended; the Age Discrimination Act of 1975, and the Omnibus Budget Reconciliation Act of 1981.  The Executive Director is the designated civil rights coordinator.

 

In the event of a civil rights complaint the Civil Rights Coordinator (CRC) of the agency has the ongoing responsibility to make himself/herself available to facilitate the preparation, filing and informal resolution of grievances.  In the event of a formal charge he/she will also be available throughout the proceedings.  Clearly outlined steps in the process appear below.

 

 

II.                Procedure

 

1.      At the onset of a complaint, the CRC will assist the applicant, employee or person served with articulating the nature and severity of the grievance.  In the event that a crisis situation exists, filing a grievance will take place at the appropriate time. The CRC will explain any and all aspects of civil rights and/or the grievance procedures upon request. 

2.      Initially, the complainant needs to be offered the name and phone number of the Ohio Civil Rights Commission in his/her area.  The address and phone number of the regional offices will be posted on the staff bulletin boards.

3.      Tarry House staff, applicants and persons served are to file the complaint with the CRC, who will begin investigating immediately.  In any case, the complainant will have an opportunity to meet with the CRC within five (5) working days of filing and have a written reply within fifteen (15) working days. All attempts will be made to have an informal resolution worked out and recorded as soon as possible. If the complainant is not satisfied with the resolution, they may appeal to the CRC for reconsideration.

4.      At any time in the complaint process, the Ohio Civil Rights Commission may be contacted.

5.      The complaint and its resolution will be forwarded to the Tarry House Board of Trustees Personnel Committee.

6.      If unresolved, the complainant will be advised of their right to file a formal charge with the Ohio Civil Rights Commission.

7.      If the complaint is filed against the Executive Director, the Chair of the Board of Trustees Personnel Committee shall handle the complaint process.

8.      A record of all complaints and their resolution will be kept on file with the agency CRC.
