I.
Purpose
To establish procedures to follow
when law enforcement officials appear and/or present subpoenas, search
warrants, investigative requests and/or other legal process.
II.
Policy
It is the policy of Tarry House,
Inc. to cooperate with law enforcement officials whenever the investigation
includes the agency or any of the agency’s employees or persons served. To that end, all employees should follow the
established procedures for responding to subpoenas, search warrants,
investigations and other legal actions.
III.
Procedure
When search warrants, or subpoenas are served, or notice of investigative
inquiries or other legal actions are given, staff are to:
1.
Ask to see
and examine the legally executed document.
2.
Notify
the Executive Director or designee immediately.
3.
Instruct
the government official that you are not authorized to allow access to the
premises, but will contact the Executive Director or Designee immediately for
the purpose of obtaining such authorization.
4.
The
Executive Director and/or his/her designee shall make the determination whether
or not staff should allow the investigation to proceed. The Executive Director and/or Designee will notify
the President of the Board of Trustees as soon as possible, as appropriate.
5.
Follow
any instructions given by Tarry House legal counsel.
6.
Do not
talk to the media.
7.
Complete
a major incident report if the investigation centers on the agency or one of
its persons served.
8.
Notify
the Corporate Compliance Officer as soon as possible.
